§ 1 CONCLUSION OF CONTRACT 

The order creates a sales contract between the customer and CARAMEL home beauty & more.

Orders are placed via the website www.caramelshop.ch after the customer has registered and accepted the present General Terms and Conditions (GTC). Orders are confirmed to the customer by email. A contract between the customer and CARAMEL home beauty & more is only concluded with this confirmation of the order. CARAMEL home beauty & more is free not to accept orders and to refuse to confirm them.  

Orders can only be placed by persons over the age of 18. Orders from minors and wards are only possible with the consent of the legal representative.

§ 2 PRICE 

The prices published on www.caramelshop.ch apply. 

Our prices are given in Swiss francs (CHF) and include the statutory value added tax (VAT). The shipping costs are not included in these prices.

§ 3 SHIPPING 

§ 3.1. DELIVERY_COSTS 

We will charge you a shipping fee (standard shipping) of only CHF 4.90 per shipment, regardless of the number of items ordered. For orders with a shopping cart value of more than CHF 70.00, the shipment will be sent postage free.

§ 3.2 DELIVERY 

The items ordered are delivered exclusively in Switzerland and Liechtenstein. CARAMEL home beauty & more assumes liability for transport and undertakes to exchange defective items. Upon receipt of the shipment, responsibility for the delivered items passes to the recipient.

§ 3.3 DELIVERY TIME 

Despite the large quantities of parcels and the difficult conditions, Swiss Post is able to process and deliver the parcels day after day thanks to the extraordinary commitment of its employees. The cooperation between the processing centers of Swiss Post and the major customers has proven itself. Meanwhile, parcel processing and delivery works stably at a high level. Nevertheless, Swiss Post continues to work according to "best effort" in individual cases it may happen that we cannot meet the delivery times.

We reserve the right to require a delivery period of between 2 and 5 working days for orders (except for goods manufactured by us, under the “more” category).

It applies to all items in stock (availability: in stock) – subject to business interruptions – and on days on which Swiss Post delivers parcels (on working days*). The reasons for delays in delivery may be beyond the control of CARAMEL home beauty & more /caramelshop.ch. 

*Business days = Monday to Friday, excluding public holidays.

§ 3.4. SHIPPING OPTIONS 

Delivery is free of charge for orders of CHF 70 or more. Otherwise, 4.90 francs will be charged for shipping. All packages are sent by PostPac Economy.

§ 4 EXCHANGE, RETURN 

For hygienic reasons, cosmetic products and products that have already been opened cannot be exchanged or returned. The products left our house in impeccable quality. If defects are nevertheless found, these must be reported within 10 days of receipt of the products via our contact form or directly via e-mail address: info@caramelshop.ch. Otherwise, the products will be deemed to have been properly accepted. The costs for the return are not borne by CARAMEL home beauty & more. If your return is checked positively, the purchase amount will be credited to your credit card.

§ 5 PAYMENT/CREDIT CHECK 

The customer can use the payment methods offered at www.caramelshop.ch for payment. Payment by invoice is only possible via Klarna, whereby the customer accepts the general terms and conditions of Klarna. The invoice for the order is therefore sent separately by Klarna. Klarna is expressly authorized to carry out credit checks at its own discretion and, if necessary, to pass on customer data to third parties for this purpose. If the customer is in arrears with payment, Klarna is entitled to commission third parties to collect outstanding payments and to assign claims to third parties at home and abroad.

§ 6 DATA SECURITY AND USE 

All data between you and the CARAMEL home beauty & more server is encrypted. Thanks to this SSL certificate, unauthorized persons have no access to the exchanged data.

CARAMEL home beauty & more uses Google Analytics, a web analysis service provided by Google Inc. A customer profile can be created by registering at www.caramelshop.ch . This can include purchasing data as well as data related to access to digital channels. When visiting digital channels, information from the log files is collected and added to the customer profile. Customer account data can be merged with data from other sources and supplemented with data from address dealers (e.g. Post Match Move).

The collected customer data may be used in particular for marketing and advertising purposes as well as for creating statistics (e.g. market research). Furthermore, customer data can be merged with other data. The data may be communicated to companies for marketing and promotional purposes.

§ 7 RESERVATION OF OWNERSHIP 

The delivered items remain the property of CARAMEL home beauty & more until full payment has been made. 

§ 8 CHANGES TO THE GTC 

CARAMEL home beauty & more reserves the right to make unilateral changes to these General Terms and Conditions.

§ 9 SEVERABILITY CLAUSE 

Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The respective statutory provisions shall take the place of the ineffective provisions.

ARTICLE 12 APPLICABLE LAW AND JURISDICTION 

The contractual provisions between you and CARAMEL home beauty & more are subject to Swiss law. Place of jurisdiction for all disputes is Zurich.
